Imai Beauty Co., Ltd. and PESCo PESCa (hereinafter referred to as
“the Company”) establish the following Privacy Policy (hereinafter
referred to as “this Policy”) regarding the handling of users’
personal information in connection with the services provided
through this website (hereinafter referred to as “the Services”).

Article 1 (Personal Information)

“Personal Information” refers to information as defined under the
Act on the Protection of Personal Information of Japan, including
information relating to a living individual that can identify a
specific individual based on the individual’s name, date of birth,
address, telephone number, contact information, or other descriptions
contained therein.

This also includes information such as facial images, fingerprints,
voiceprints, and other information that can identify a specific
individual from the information itself, such as an insurer number
on a health insurance card.

Article 2 (Methods of Collecting Personal Information)

The Company may ask users to provide personal information such as
their name, date of birth, address, telephone number, email address,
bank account number, credit card number, driver’s license number,
and other information when users register to use the Services.

The Company may also collect transaction records and payment-related
information containing users’ personal information from business
partners, including information providers, advertisers, and
advertising distributors (hereinafter referred to as “Business
Partners”).

Article 3 (Purposes of Collecting and Using Personal Information)

The Company collects and uses personal information for the following purposes:

  1. To provide and operate the Services.
  2. To respond to inquiries from users, including identity verification.
  3. To send emails regarding new features, updates, campaigns,
    and other services provided by the Company.
  4. To contact users regarding maintenance, important notices,
    and other necessary matters.

Article 4 (Changes to the Purpose of Use)

  1. The Company may change the purpose of use of personal information
    only when it is reasonably determined that the new purpose is
    reasonably related to the original purpose.
  2. If the purpose of use is changed, the Company shall notify users
    of the revised purpose or publicly announce it on this website
    by the method prescribed by the Company.

Article 5 (Provision of Personal Information to Third Parties)

  1. The Company will not provide personal information to third parties
    without obtaining the user’s prior consent, except in the following
    cases or where otherwise permitted by applicable laws and regulations.

    1. When it is necessary to protect a person’s life, body, or
      property, and it is difficult to obtain the individual’s consent.
    2. When it is particularly necessary to improve public health
      or promote the sound development of children, and it is
      difficult to obtain the individual’s consent.
    3. When cooperation with a national or local government agency,
      or a person entrusted by such agency, is necessary for the
      performance of duties prescribed by law, and obtaining the
      individual’s consent may impede the performance of such duties.
    4. When the Company has publicly announced or notified the
      following matters in advance and has submitted a notification
      to the Personal Information Protection Commission:

      1. The purpose of use includes provision of information to third parties.
      2. The items of personal information to be provided to third parties.
      3. The means or method of providing information to third parties.
      4. The Company will cease providing personal information
        to third parties upon the individual’s request.
      5. The method for accepting requests from the individual.
  2. Notwithstanding the preceding paragraph, the recipient of the
    information shall not be considered a third party in the following cases:

    1. When the Company outsources all or part of the handling of
      personal information to the extent necessary to achieve
      the purpose of use.
    2. When personal information is provided in connection with
      a business succession due to a merger or other reasons.
    3. When personal information is jointly used with a specific
      person or entity, provided that the relevant information,
      including the items of personal information jointly used,
      the scope of persons or entities jointly using the information,
      the purpose of use, and the person or entity responsible
      for managing the personal information, has been notified
      to the individual in advance or made readily accessible
      to the individual.

Article 6 (Disclosure of Personal Information)

  1. When the Company is requested by an individual to disclose
    personal information, the Company shall disclose such information
    to the individual without delay.

    However, the Company may decide not to disclose all or part of
    the information if disclosure falls under any of the following
    cases. If the Company decides not to disclose the information,
    it shall notify the individual without delay.

    A fee of JPY 1,000 per request will be charged for the disclosure
    of personal information.

    1. When disclosure may harm the life, body, property, or
      other rights or interests of the individual or a third party.
    2. When disclosure may significantly interfere with the
      proper conduct of the Company’s business.
    3. When disclosure would otherwise violate applicable laws
      or regulations.
  2. Notwithstanding the preceding paragraph, the Company generally
    does not disclose information other than personal information,
    such as browsing history and characteristic information.

Article 7 (Correction and Deletion of Personal Information)

  1. If a user’s personal information held by the Company is incorrect,
    the user may request the Company to correct, add, or delete
    the relevant personal information in accordance with procedures
    prescribed by the Company.
  2. If the Company determines that it is necessary to respond to
    such a request, the Company shall promptly correct, add, or
    delete the relevant personal information.
  3. If the Company makes such corrections, additions, or deletions,
    or decides not to do so, the Company shall notify the user
    without delay.

Article 8 (Suspension of Use of Personal Information)

  1. If the Company receives a request from an individual to suspend
    or delete the use of personal information (hereinafter referred
    to as “Suspension of Use”) on the grounds that the information
    is being handled beyond the scope necessary to achieve the
    purpose of use or was obtained through improper means,
    the Company shall promptly conduct the necessary investigation.
  2. If the Company determines, based on the results of the investigation,
    that it is necessary to comply with the request, the Company
    shall promptly implement the Suspension of Use of the relevant
    personal information.
  3. If the Company implements the Suspension of Use or decides not
    to do so, the Company shall notify the user without delay.
  4. Notwithstanding the preceding two paragraphs, if the Suspension
    of Use would require substantial costs or would otherwise be
    difficult to implement, and alternative measures necessary to
    protect the user’s rights and interests can be taken, the Company
    shall take such alternative measures.

Article 9 (Changes to this Privacy Policy)

  1. The contents of this Policy may be changed without notifying
    users, except as otherwise provided by laws, regulations,
    or this Policy.
  2. Unless otherwise specified by the Company, the revised Privacy
    Policy shall become effective when it is posted on this website.
